A close relative in terms of communicating information about a patient's condition (Part 2)

15 December 2022

The patient's right to information about his or her condition is one of the patient's rights regulated by the provisions of the Act of 6 November 2008 on Patients' Rights and Patients' Ombudsman. In certain circumstances (when the patient is under 16 years of age, unconscious or incapable of understanding the meaning of the information), the doctor should provide the information to his or her relative, who is defined in the law as: a spouse, relative or relative up to the second degree in a straight line, a legal representative, a person cohabiting with the patient or a person indicated by the patient. The above-described duty of the doctor is provided for in the provisions of the Act of 5 December 1996 on the professions of doctor and dentist. This article explains the conditions under which a doctor may provide information about a patient's state of health to his or her relative.
